SeaWorld trainers describe colleague's death by killer whale (Reuters)

SANFORD, Fla (Reuters) ? A former SeaWorld employee recalled on Thursday watching a 12,000-pound killer whale pull a trainer underwater by her ponytail in 2010 and hold on to her for up to 45 minutes.

Jan Topoleski said Dawn Brancheau, 40, had been working to get the orca bull named Tilikum to lay on his back in his pool next to where Brancheau was lying on a shallow ledge.

"I saw her get up to her knees and put her hand to her ponytail, when I saw she couldn't break free," said Topoleski, who worked as a killer whale trainer and spotter at the Orlando, Florida amusement park at the time of the incident.

He said his last image of Brancheau was that she had "both hands on her ponytail being pulled into the water."

Topoleski, who now works with FBI dogs, testified in the fourth day of a federal hearing in Sanford, where SeaWorld is challenging safety charges that stem from Brancheau's death.

The most serious charge by the Department of Labor's Occupational Safety and Health Administration (OSHA) is classified as a "willful violation," meaning SeaWorld showed "plain indifference to or intentional disregard for employee safety and health."

Federal lawyer John Black has said SeaWorld offers its trainers little more protection than lessons in how to recognize visual clues that a killer whale might become aggressive.

The company faces a $75,000 fine. More significantly, SeaWorld might be forced to end physical interaction between trainers and killer whales, company lawyer Carla Gunnin said at the hearing this week.

NO RESPONSE TO SIGNALS

Topoleski testified he sounded an alarm after Brancheau was grabbed by Tilikum and executed rehearsed callback signals in an attempt to get the whale to let Brancheau go.

"Tilikum did not respond to callback signals?" federal lawyer Tremelle Howard-Fishburne asked.

"During the rescue operation, he did not," Topoleski said.

Topoleski said Tilikum held onto Brancheau for 40-45 minutes until the whale was corralled in a smaller section of the pool.

Earlier on Thursday, another SeaWorld animal trainer who helped try to rescue Brancheau broke down on the witness stand when she was shown a photo of herself standing next to Tilikum.

"That's where I was standing when the incident occurred," trainer Shana Groves told federal administrative judge Ken Welsch, who asked why the photo upset her.

Groves, who said she asked for and received a transfer out of the killer whale show as a result of the drowning, testified she raced to the pool when the alarm sounded and helped throw a net trainers are taught to use in emergencies to try to distract an out-of-control whale.

Groves also described an incident in 2006, when a different killer whale, Ikaika, bit down on her thigh during a public performance. Groves said she was performing a maneuver in which she would lie down on the pool side and ask the whale to lie down in the water next to her, but Ikaika instead chose to grab her thigh.

"I asked him for a mouth open. He opened his mouth. I sent him on bows, which are jumps," Groves said.

Groves said she wrote up an incident report about Ikaika as required by SeaWorld when a killer whale acts in a way that could become aggressive. Groves testified she was surprised to learn from federal lawyers that SeaWorld did not include her report in the killer whale incident log provided to OSHA.

The hearing is scheduled to last a week, and a ruling could take several months.

Cholesterol-lowering Drugs May Treat Brain Cancer | www.dailyrx.com

One of the most exciting frontiers in oncology is discovering molecular behavior that responds to existing drug therapies. Just such a discovery has been made regarding a deadly form of brain cancer.

Researchers have found that glioblastoma, one of the most lethal forms of brain cancer, needs large amounts of cholesterol to survive and grow. This finding opens the door to testing if cholesterol-lowering agents could be used to treat this cancer.

Early results show that cholesterol meds may treat brain cancer.

Investigators have uncovered that a cancer-causing gene known as EGFR VIII increases production of cholesterol.?Lead investigator, Paul Mischel, M.D., professor at the David Geffen School of Medicine at the University of California, Los Angeles, says this is not surprising given the fact that cholesterol is crucial in making new membranes - something fast growing tumors need in abundance.

This study, which involved glioblastoma cell lines, mouse models and clinical samples taken from patients, adds to the growing body of work focusing on cutting off the supplies tumors need to grow.

Among the candidates that hold promise is a class of drugs known as vascular endothelial growth factor inhibitors, which block blood supply to the tumor. Avastin (bevacizumab) was named in the study.

Dr. Mischel concludes that if this laboratory study can be confirmed in larger studies, cholesterol-lowering medications may become a glioblastoma treatment option.

This study was published study published in Cancer Discovery, the newest journal of the American Association for Cancer Research.

Brain Tumors

Each year in the United States, over 25,000 people will be newly diagnosed with some form of primary malignant brain tumor, and over 90,000 people are currently living with the disease and undergoing treatment. Approximately 13,000 of these patients will die from the disease, representing 2% of all cancer deaths.

Brain tumors encompass a wide variety of types of cancer, some more aggressive than others. They include:

  • Glioblastoma multiforme (GBM) ? A deadly tumor forming in the white matter of the brain. Makes up 52% of all cerebral tumors and most common in white and Asian men over age 50. It is very difficult to treat and average survival after diagnosis is 14 months.
  • Astrocytoma ? a tumor that forms from the glial cells in the brain (support cells for neurons). These can be benign or malignant (GBM is a form of astrocytoma) and appear in young children as well.
  • Oligodendroglioma ? arise from the oligodendrocytes (insulating cells for axoms). They appear mostly in adults around age 35 and represent about 10% of all primary brain tumors and tend to recur after treatment.
  • Ependymoma ? arises from tissues in the brain that surround the drainage system of the brain. They represent about 5% of adult brain tumors, and 10% of pediatric brain tumors, peaking at age 35 and earlier at age 5. Often they end up causing hydrocephalus, or ?water on the brain."

Brain tumors are caused by a change in genetics, much like any other cancer that causes cells to grow out of control. Some brain tumors are associated with specific chromosomal changes, but in most cases, the cause of a brain tumor is unknown, and due to some combination of genetic instability and environmental damage.

Symptoms of a brain tumor depend mainly on the size of the tumor and where it is located in the brain. Because the brain is housed in the skull, a growing tumor will cause something called mass effect, where the enlarging tumor is taking up too much space and cause increased pressure in the brain. This can cause terrible headaches, nausea, vomiting, and changes in consciousness among other specific signs. In other cases, the growing tumor may encroach upon a part of the brain that has a specific function, and cause that function to cease. Depending on what part of the brain the tumor is in, language, motor coordination, vision, balance, and paralysis can occur. In both cases, a brain tumor can present immediately or after several years of growing.

Diagnosis of a brain tumor will ultimately be made by CT scan and MRI. Treatment of brain tumors involves surgery, radiation, and chemotherapy, or some combination of the three. Each modality presents its own risks and benefits. Surgery is sometimes not possible because of risk to damage of vital brain structures necessary for life.

Prognosis for a brain tumor is entirely dependent on the type of tumor and its location. Some tumors grow very fast and are inoperable due to the cell type and location, and these patients have a poor prognosis. Other brain tumors can be lived with for years, or quickly and easily treated with surgery.

Regulators from five states will address the American Association of Debt Management Organizations? (AADMO) Fall Conference. The panels will discuss current enforcement efforts, license requirements and the specific elements of the laws.

Last wrongful death lawsuit from 9/11 settled

(AP) ? The last wrongful death lawsuit remaining from the 9/11 terrorist attacks was settled Monday when a family that sought to expose weaknesses in the nation's air safety system decided it had done what it could to give voice to a hockey scout who died that day.

The family of Mark Bavis decided to settle after making public as much information as it could about what it viewed as security lapses on Sept. 11, 2001, at Boston's Logan Airport, where United Airlines Flight 175 originated, attorney Donald Migliori said. He said the family had decided to settle as it became clear that a trial scheduled to begin Nov. 7 would be limited to three weeks.

In a statement, United Airlines said: "The tragic events of 9/11 impacted all of us, and we are pleased to resolve this case." St. Louis-based Huntleigh USA Corp., a security company that also was named in the lawsuit, did not immediately respond to a request for comment Monday.

The terms of the settlement were not disclosed.

Bavis, a Newton, Massachusetts, scout for the Los Angeles Kings hockey team, was aboard Flight 175 when it took off from the airport, was overtaken by terrorists and flown into the south tower on Sept. 11. The lawsuit was filed by his mother, Mary Bavis.

Migliori said it gave the family relief that some important information about airport and airline security was placed in the public court record prior to trial.

"That gave them some peace and allowed them to live on," he said.

But he said that the family had not given up on bringing scrutiny to airport screening. "They think they can give Mark voice long after this case is over," Migliori said. "Their goal is to make future travel safer."

In a court filing Friday, lawyers for the Bavis family blamed United and Huntleigh for security failures that they said enabled the terrorists to hijack the plane.

They said the companies failed to hire and retain qualified screeners and to properly train them for the growing threat of terrorism.

On the morning of the attacks, at least nine screeners were unaware that the threat level had been raised to a level which meant terrorists with a known capability to attack civil aviation were likely to carry out attacks against U.S. targets, they said.

"Shockingly, employees at the management level were also in the dark," they wrote, naming four managers.

They said at least nine screeners had never heard of Osama bin Laden or al-Qaida and neither had Huntleigh's director of training and its general manager at Logan.

The lawyers wrote that a majority of the screeners on duty at the Flight 175 checkpoint that morning were immigrants who spoke limited English.

They said one of the pre-board screeners had such a poor grasp of English that she required an interpreter during her deposition, and another screener during his deposition had to have questions repeated multiple times because he could not understand English.

The lawyers said the family was prepared to show at trial "a litany of evidence suggesting that the hijackers on Flight 175 used knives, Mace and pepper spray to overtake and intentionally crash the aircraft."

Bavis, who was 31 years old, was in seat 19F of the flight from Boston to Los Angeles International Airport.

Other than one tiny bone fragment, his remains were never found. Drafted by the New York Rangers, Bavis played three seasons of professional hockey before coaching hockey at Brown and Harvard universities.

Both he and his twin brother, Mike, were hockey stars in high school and college.

Google Propeller Social News Sharing App to Compete Against Flipboard [REPORT] (Mashable)

Google is creating a social news sharing app for iPad and Android that will compete directly with Flipboard, named 2010 iPad App of the Year by Apple. The first word of Google's rumored app that turns social media and news content into magazine-like articles was from Google+ about what he's heard from "someone working with Google" about the news-sharing reader:

"Google is working on a Flipboard competitor for both Android and iPad. My source says that the versions he's seen so far are mind-blowing good."

All Things D's Kara Swisher adds fuel to that fire, saying that her sources have told her the new iPad and Android app is called Propeller, which she calls a "souped-up version of similar reading apps such as Flipboard, AOL's Editions, Yahoo's Livestand, Zite and Pulse."
